Advisor Year-End Checklist: Prepare for a 2027 Move

Advisor Year-End Checklist: Prepare for a 2027 Move

A recruiting offer can make the next chapter look straightforward. But a seamless move is built long before the resignation letter.

If you’re considering changing firms in 2027, use the remainder of 2026 to establish readiness and explore a rapidly shifting economic and geopolitical landscape. Before committing, review your restrictions, confirm client-data boundaries, assess account portability, compare the economics, and determine what your next business model requires.

A savvy Advisor’s year-end checklist:

Vesting dates, payout timing, and notice periods all run on a schedule, and knowing yours turns "someday" into a date you can plan around.

Let’s evaluate core considerations in the wealth management space for 2027 and beyond.

Review Your Employment Agreement, Non-Competes, and the Broker Protocol

Before taking any external meetings or announcing your intentions, you must thoroughly audit your existing employment agreements and regulatory obligations.

The Broker Protocol Check: Determine whether your current firm and your prospective destination are signatories to the Broker Protocol. When executed correctly, moving under the Protocol allows departing Advisors to take just 5 specific client contact details (name, address, phone number, email, and account title) without fear of injunctive relief.

If either firm isn't a signatory, what you may take, if anything, comes down to your employment agreement. Firms can join or leave at any time, so confirm both firms' status close to your resignation date.

Restrictive Covenants & Non-Solicits: If your firm has opted out of the Protocol, examine your non-solicitation, non-compete, or garden leave provisions. Understanding these boundaries early prevents costly legal friction during notice period.

Unvested Equity and Forgivable Notes: Calculate the exact financial impact of unvested deferred compensation, unvested stock, or lingering transition loan balances so you can factor them into your upfront deal negotiations.

What Should You Do (and Not Do) With Client Data?

Take nothing, and solicit no one, before you resign. Preparing means organizing what you already know and looking forward to exhilarating new opportunities.

  • Keep serving clients the way you always have. Year-end reviews are business as usual – no hints and no "just in case" conversations. On a Protocol move, solicitation typically starts only after you resign.
  • Keep personal devices clean. Avoid storing firm information on personal devices unless policy specifically allows it.
  • Hold the announcements. Updating your bio before you resign can be construed as solicitation. Afterward, have compliance review every word; our SEC Marketing Rule Checklist is a good start.
  • Move as a team, comply as individuals. Each colleague joining you needs to follow the rules independently.

Clients follow Advisors they trust, not paperwork. Use Q4 client check-ins to deliver personalized, active listening and reinforce your value proposition.

When your client relationships are rooted in deep personal engagement, clients will naturally seek to continue working with you, regardless of your firm affiliation.

Map Out Your Entity Setup, Technology, and Custodial Partners

Establishing your future business infrastructure takes several months, making year-end the ideal time to evaluate options for a 2027 launch.

Structure & Business Model: Decide whether your goals are best served by launching your own independent RIA, joining a turnkey boutique RIA platform, or moving to an independent broker-dealer (IBD). Consider corporate entity structures (e.g., LLC or S-Corp) early with your CPA and legal team.

Custodial and Tech Selection: Evaluate institutional custodians (such as Schwab, Fidelity, LPL, or Pershing) and compare integrated tech stacks covering CRM, portfolio management, AI planning tools, and compliance software.

Frequently Asked Questions About a 2027 Advisor Move

Can financial advisors still be subject to non-compete agreements?

Yes, potentially. The FTC’s nationwide ban is not in effect, but the Commission has signaled a strong intent to continue case-by-case enforcement. Whether a particular restriction is enforceable depends on the agreement, applicable law, and circumstances. Have counsel review it before acting.

What client information can an Advisor take under the Broker Protocol?

For a qualifying move, and subject to the Protocol’s conditions, the permitted categories are client name, address, telephone number, email address, and account title. That does not authorize taking unrestricted client records.

Do I need to form an LLC before changing firms?

Not every move requires a new entity. Joining an existing firm differs from launching your own business. Entity formation also does not replace advisory-firm or individual registration requirements.

Should I wait until January to start planning?

Use the remaining months of 2026 to evaluate options and resolve questions. Keep planning separate from resignation, client outreach, and data transfers, with counsel directing the boundaries.

Make Your Next Move Deliberate

The right opportunity should stand up to scrutiny – of the agreements, platform, economics, and support behind it.
